Welcome to Tickle Me Sweet Cupcakery, LLC! Please review the following Terms and Conditions carefully before placing an order with us. By using our services and purchasing our products, you agree to comply with the following terms:
1. Orders
Order Placement: All orders must be placed via our website: www.tickleme-sweet.com, email: info@tickleme-sweet.com or by phone: 832-578-5006 with at least 2-4 weeks’ notice prior to the desired delivery or pick-up date. Due to order customizations, please call to ensure that all details are accurate prior to order placement. Rush orders may be accommodated based on availability and will incur additional fees.
Order Confirmation & Modifications: Your order is confirmed only after we have received a deposit or full payment. Once confirmed, changes to the order may not be possible or may incur additional charges based on the request. Please contact us 3-5 days prior to your order’s pickup or delivery date regarding modifications. Please be aware that due to order customizations, some order modification requests cannot be guaranteed.
2. Pricing
Custom Pricing: The price of custom items such as Cakes and Sugar Cookies will depend on the order's design, size, and complexity. We will provide a quote after discussing your specific needs.
Payment: All payments must be made in full prior to the start of your order. We accept payments via the following payment methods: Credit/Debit card, Zelle, Apple Pay, Venmo, and CashApp, with no CODs. Please be advised that a 50% non-refundable deposit is required to secure your order. All orders, $100 or less are to be paid in full, upfront. If payment is not received within 24 hours of order placement or on a specified date, your order will be canceled, and a second invoice will not be submitted. Additionally, future orders will not be accepted.
Discounts and Promotions: Promotional prices are valid only during the specified promotional period and cannot be combined with any other discounts.
3. Cancellations and Refunds
Order Cancellation: Please be advised that Order Cancellations will not be refunded due to the perishable nature of our products and the preparation time required. There will be a Store Credit issued, which will be valid for 12 months from your Order Cancellation date.
Refunds and Returns: Due to the custom nature of our baked goods, all sales are final once the order has been picked up or delivered. If there is an issue with your order, please notify us within 24-48 hours, and we will work with you to resolve the matter.
4. Delivery and Shipping
Pick-Up: Orders can be picked up from Spring, TX at no additional charge. Pick-up times must be confirmed in advance.
Delivery: Local delivery is available for an additional fee of $50 to locations that exceed 10 miles of Spring, TX. Delivery times will be coordinated in advance. We are not responsible for any delays or issues caused by incorrect delivery information provided by the customer.
Shipping: Shipping is available at an additional charge for certain products. We ship via USPS, and shipping times may vary based on location. While we take great care in packaging our products to ensure they arrive in good condition, we are not responsible for damages or delays caused during shipping.
5. Allergies and Dietary Restrictions
Ingredients: Our products may contain allergens such as wheat, eggs, dairy, nuts, and other allergens. We are not a certified allergen-free kitchen, and cross-contamination may occur. Please notify us of any allergies when placing your order, and we will do our best to accommodate your needs. However, we cannot guarantee allergen-free products.
Dietary Restrictions: We offer certain items that may be gluten-free, vegan, etc., upon request. However, please note that while we can accommodate special dietary requests, our kitchen is not dedicated to these dietary restrictions.
6. Product Quality
Customization: Each custom item is handmade, and slight variations in design, color, and appearance may occur. We strive to meet your specifications as closely as possible but cannot guarantee exact replicas.
Shelf Life: Our baked goods are best enjoyed within 5 days of purchase. Please store your items according to our provided instructions to maintain freshness.
7. Liability
Limitations of Liability: We are not responsible for any damages, losses, or allergic reactions resulting from the consumption of our products. By purchasing our products, you agree to release Tickle Me Sweet Cupcakery, LLC from any liability related to these issues.
8. Intellectual Property
Content and Designs: All images, designs, and content on our website and social media platforms are the intellectual property of Tickle Me Sweet Cupcakery, LLC. You may not use, copy, or distribute any of this content without prior written consent.
9. Privacy
Personal Information: Any personal information you provide to us (such as name, address, phone number, etc.) is used solely for the purpose of completing your order. We do not share your information with third parties, except as necessary to process your payment or deliver your order.
10. Changes to Terms
Modification of Terms: We reserve the right to update or modify these terms without prior notice. Please review these terms regularly to stay informed of any changes.
